GOOGLE.ORG GRAM PANCHAYAT PURUSKAR CONTEST RULES


NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. CONTEST IS OPEN ONLY TO GRAM PANCHAYATS IN THE STATES OF KARNATAKA AND ANDHRA PRADESH, INDIA.

ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

The Google.org Gram Panchayat Puraskar (the “Contest”) is a contest where participating Gram Panchayats must submit an application either on paper or online that showcase an innovation that has had some impact on the provision of public services. This innovation has to be in the context of the following six areas:

  • Education
  • Health and nutrition
  • Water supply
  • Rural infrastructure
  • Rural electrification
  • Resource mobilization

Innovation will be defined as a Gram Panchayat going above and beyond the call of duty in the programs mentioned above. The Gram Panchayat will have to demonstrate the following

  • Participation/inclusion of all social and income groups in village decision-making or planning. This should include vulnerable groups like Scheduled Caste/Scheduled Tribe /Other Backward Castes, women, youth, etc.
  • Transparency to villagers. This could include proactively sharing information with villagers on:
    • Eligibility, entitlements and progress of the programs
    • Gram Sabha dates, proceedings and action items
    • Record maintenance
    • Gram panchayat plan
  • Community tracking and monitoring of the budgets and quality of the programs
  • Convergence with other programs to reach public service delivery objectives

The applications will be evaluated by judges, who will choose the winning entry in accordance with these Official Rules. The prize(s) will be awarded to the top 5 Gram Panchayats in each State. See below for the complete details.

  1. BINDING AGREEMENT: In order to enter the Contest, you, on behalf of your Gram Panchayat, must agree to these Contest Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Google India Pvt. Ltd. with respect to the Contest.

  2. ELIGIBILITY: To be eligible to enter the Contest, you must be: (1) a legal recognized Gram Panchayat in the states of Karnataka or Andhra Pradesh, India (2) not an entity under U.S. export controls or sanctions. These rules are binding on you, in your capacity as the legal representative of your Gram Panchayat. You warrant that your Gram Panchayat has full knowledge of your actions and has consented thereto. You further warrant that your actions do not violate any applicable laws, policies and procedures.

  3. SPONSOR: The Contest is sponsored by Google India Pvt. Ltd. (“Google” or “Sponsor”), an Indian corporation with principal place of business at 1st Floor, Prestige Sigma, #3, Vittal Mallya Road, Bangalore, Karnataka-KA, 560001, India.

  4. CONTEST PERIOD:The Contest begins on December 12, 2008 and ends on February 15, 2009 ("Contest Period").

  5. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. To enter the Contest, visit the Contest website located at www.google.org/ggpp.html (“Contest Site”) or pick-up an application at your district panchayat office in Karnataka or Andhra Pradesh during the Contest Period and follow the instructions for submitting an entry (“Entry”).

  6. LIMIT ONE (1) ENTRY PER GRAM PANCHAYAT: Subsequent entries will be disqualified. All entries must be post-marked by February 15, 2009. Entries are void if they are in whole or part illegible, incomplete, damaged, altered, counterfeit, obtained through fraud, or late. All entries will be deemed made by the Sarpanch of the Gram Panchayat.

  7. JUDGING: Beginning in February, 2009 each Entry will be evaluated by the Judges based on the following criteria:

      • Knowledge creation

      • Potential impact
      • Sustainability/self sufficiency
  8. Judges will evaluate and attribute a score to each Entry made up of scores based upon the above-listed criteria. The 20 entries in each State that receive the highest overall scores will be selected as the Finalists.

    The Final Round of judging will occur on or about April 2009. The Entries of the top 5 Finalists in each State that receive the highest overall scores from the Judges will be selected as the potential Winners. All potential Winners will be required to pass a legal due diligence review and execute a grant agreement before receiving a prize.

  9. FINAL ROUND: The Final Round of judging will occur on or about April 2009. The Entries of the top 5 Finalists in each State that receive the highest overall scores from the Judges will be selected as the potential Winners. On or about April 2009 the potential Winners will be selected and notified by telephone and the names of the Winners will be posted on the Contest Site. In the event a potential Winner is disqualified for any reason, the Finalist’s Entry that received the next highest total score will be chosen as a Winner. In the event that no Entries are received, no prize will be awarded. The determinations of judges are final and binding. All potential Winners will be required to pass a legal due diligence review and execute a grant agreement before receiving a prize.

  10. PRIZES: There will be a total of 10 prizes, 5 for each State. Each prize will be INR 500,000. Winners will be notified and their names will be listed on the Contest Site. Winners agree the prize may not be used for the following activities:
    • Any religious activities or purpose;
    • Salaries or any other compensation to individuals;
    • Any activities that only benefit individuals; and
    • Any activities in breach of applicable law.

  11. TAXES: PAYMENTS TO POTENTIAL WINNERS ARE SUBJECT TO THE EXPRESS REQUIREMENT THAT THEY SUBMIT TO GOOGLE ALL DOCUMENTATION REQUESTED BY GOOGLE TO PERMIT IT TO COMPLY WITH ALL APPLICABLE FEDERAL, STATE, PROVINCIAL, LOCAL AND FOREIGN TAX REPORTING AND WITHHOLDING REQUIREMENTS. ALL PRIZES WILL BE NET OF ANY TAXES GOOGLE IS REQUIRED BY LAW TO WITHHOLD. ALL TAXES IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. In order to receive a prize, potential winners must submit the tax documentation requested by Google or otherwise required by applicable law, to Google or the relevant tax authority, all as determined by applicable law. The potential winner is responsible for ensuring that it complies with all the applicable tax laws and filing requirements. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and Google may, in its sole discretion, select an alternative potential winner.

  12. GENERAL CONDITIONS: All federal, state, provincial and local laws and regulations apply. Google reserves the right to disqualify any entrant from the Contest if, in Google’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Google, or the Judges.

  13. VIDEOS: Google will offer to all Finalists the opportunity of having a video filmed (no longer than 2 minutes) to augment their respective Entries, provided that the respective Finalist and any person appearing in a video, sign a release allowing Google to film the entry and to allow such video to be posted on YouTube. The Finalists will not be required to submit a video and will not be disqualified from the competition if they do not agree to be filmed. The video content will be solely determined by the respective Finalists provided that such content does not violate the YouTube Terms of Use. The final video posted on YouTube will be approved by the respective Finalists. The Finalists understand that Google reserves the right, at its sole discretion, to not include a video component in the Competition.

  14. PRIVACY: Participants agree that personal data entered during the registration, including name, mailing address, phone number, and email address may be processed, stored, shared and otherwise used for the purposes and within the context of the Contest.

    Participants also understand this data may be used by Sponsor in order to verify an entrant’s identity, postal address and telephone number in the event an entry qualifies for a prize. If a participant does not provide the data required at registration, that participant’s entry will be ineligible. Otherwise, all personal information that is collected from the entrant is subject to Google’s Privacy Policy.

  15. PUBLICITY: By accepting a prize, entrant agrees to Sponsor use of its name and Video for advertising and promotional purposes without additional compensation, unless prohibited by law.

  16. WARRANTY AND INDEMNITY: To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Google at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless Google from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from (a) any misrepresentation made by the entrant in connection with the Contest; (b) any non-compliance by the entrant with these Rules; (c) claims brought by persons or entities other than the parties to these Rules arising from or related to the entrant’s involvement with the Contest; (d) acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest; (e) any malfunction or other problem with the Contest Site; (f) any error in the collection, processing, or retention of entry information; or (g) any typographical or other error in the printing, offering or announcement of any prize or winners.

  17. ELIMINATION: Any false information provided within the context of the Contest by any entrant concerning identity, mailing address, telephone number, email address, ownership of right or noncompliance with these Rules or the like may result in the immediate disqualification of the entrant from the Contest.

  18. INTERNET: Google is not responsible for any malfunction of the entire Contest Site or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed Videos due to system errors, failed, incomplete or garbled computer or other telecommunication transmission malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Contest Site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate.

  19. RIGHT TO CANCEL, MODIFY OR DISQUALIFY. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Google reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Google further reserves the right to disqualify any entrant who tampers with the submission process or any other part of the Contest or Contest Site. Any attempt by an entrant to deliberately damage any web site, including the Contest Site, or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Google reserves the right to seek damages from any such entrant to the fullest extent of the applicable law.

  20. NOT AN OFFER OR CONTRACT OF EMPLOYMENT: Under no circumstances shall the submission of an Entry into the Contest, the awarding of a prize, or anything in these Rules be construed as an offer or contract of employment with Google. You acknowledge that you have submitted your Entry voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and Google and that no such relationship is established by your submission of an Entry under these Rules.

  21. FORUM AND RECOURSE TO JUDICIAL PROCEDURES: These Rules shall be governed by, subject to, and construed in accordance with the laws of the Government of India, excluding all conflict of law rules. Courts in Bangalore shall have exclusive right for trial of any disputes. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all Participants expressly waive any and all such rights.

  22. ARBITRATION: By entering the Contest, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the Contest will be decided by binding arbitration. The parties agree that they will try in good faith to settle within 30 days any dispute, controversy or claim arising out of, relating to or in connection with this Agreement ("Dispute"). If the Dispute is not resolved within 30 days after such Dispute arose, such Dispute must be referred to and finally resolved by arbitration, to which the parties hereto expressly agree and submit. The arbitration will be submitted to a sole arbitrator, mutually selected by the parties and conducted in accordance with the Arbitration Rules under the Indian Arbitration Act, 1996 ("Rules"). The arbitral tribunal will not act as amiable compositeur or ex aequo et bono. It is the intent of the parties that, barring extraordinary circumstances, arbitration proceedings will be concluded within 60 days from the date the arbitrator is appointed. The arbitral tribunal may extend this time limit in the interests of justice. Failure to adhere to this time limit shall not constitute a basis for challenging the award. The arbitration will be conducted in English and the place of arbitration will be in Bangalore. Either party may, without waiving any remedy under this Agreement, apply to the arbitral tribunal and/or any court having jurisdiction any interim, provisional, injunctive or conservatory relief that is necessary to protect the rights or property of that party until the arbitration award is rendered or the Dispute is otherwise resolved. Any decision rendered by the arbitral tribunal will be final and binding on the parties, and judgment thereon may be entered by any court of competent jurisdiction, including, but not limited to, any court that has jurisdiction over either of the parties or any of their assets. The parties expressly agree that the arbitral tribunal will be empowered to award and order equitable or injunctive relief with respect to matters brought before it, provided however, that such remedy or relief is consistent with the remedies and limitations set forth in this Agreement. The parties agree that all arbitral proceedings conducted pursuant to this Section, including the existence of any arbitral proceedings, information disclosed in the course of such arbitral proceedings, and any settlements, negotiations, discussions, proposals, and awards related thereto shall be considered Confidential Information and shall be governed by the confidentiality provisions of this Agreement. The parties may, however, disclose such information to an appropriate court, as is necessary to seek enforcement of any award rendered by the arbitral tribunal or to seek any interim, provisional, injunctive or conservatory relief pursuant to the terms hereof. The parties specifically exclude from application to the Agreement the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act.
